Terms and conditions (AGB)
General terms and conditions for enquiries, commissions and services of the KRAFTKERN studio.
1. Scope
These terms and conditions apply to all enquiries, offers, commissions and services of KRAFTKERN (sculpture, spatial installation, fabrication), operated by VSNZ Entertainments RUBI, Mittelweg 9, 3812 Wilderswil, Switzerland. They apply to work commissioned by artists, architects, galleries, institutions and private clients. Deviating terms of the client only apply if confirmed by us in writing.
2. Enquiry and offer
An enquiry via the website, by e-mail or in person is non-binding. A commission arises only through our written offer and the client's written acceptance, or through a signed agreement. Concept visualisations shown on this website are studies of pieces in development and do not constitute an offer.
3. Prices and payment
All prices are quoted in Swiss francs (CHF) and, unless stated otherwise, exclude VAT and transport, installation and assembly costs. For commissions, an advance payment of 50% of the agreed price is due upon commissioning; the remainder is due upon completion or delivery. Payments are made by bank transfer to the account stated in the offer.
4. Design, execution and changes
Design, material selection and fabrication follow the agreed offer. Changes requested by the client after acceptance that affect material, dimensions or schedule are charged separately and may shift the delivery date. We reserve the right to deviations customary in craft production; each piece is individually made.
5. Delivery, installation and acceptance
Delivery dates are approximate unless expressly agreed as binding. Risk passes to the client upon handover or, in the case of shipment, upon dispatch. Installation on site follows the agreed safety requirements; the client ensures safe access and conditions at the installation location. The client must inspect the work upon handover and report obvious defects without delay.
6. Cancellation
If the client cancels a commission after acceptance, compensation of 30% of the agreed price is due for work performed and capacity reserved, unless a higher actual effort is proven. Materials already procured are charged at cost.
7. Copyright and use
The copyright and all design rights in sketches, models, digital studies and finished works remain with Benjamin Rubi / KRAFTKERN. Reproduction, documentation and publication of the works — including by the client — require our consent. Photographic documentation of completed works may be used by us for reference and promotional purposes unless agreed otherwise in writing.
8. Liability
Liability is limited to intent and gross negligence. Liability for indirect or consequential damage is excluded to the extent permitted by law. We accept no responsibility for damage caused by improper handling, unsuitable installation conditions or unauthorised modification of a work.
9. Confidentiality
Enquiries marked as confidential are treated confidentially. A confidentiality request starts a conversation about appropriate handling; it does not create a non-disclosure agreement unless separately signed.
10. Data protection
Personal data collected in the enquiry process is used exclusively to review and respond to the enquiry, as described in the enquiry privacy notice. Data is not passed on to third parties unless required by law.
11. Applicable law and jurisdiction
These terms are governed by Swiss law. The place of jurisdiction for all disputes arising from these terms is Bern, Switzerland, to the extent permitted by law.
Acceptance
By commissioning work or accepting an offer, the client agrees to these terms and conditions. Status: October 2026. Operator details are set out in the imprint.
